Überwachungskameras auf dem Universitätsgelände

Jeder Mensch hat ein Recht auf informationelle Selbstbestimmung. Das StuPa fordert den UStA daher auf, regelmäßig zu prüfen, welchen Zweck die Überwachungskameras auf dem Universitätsgelände erfüllen. Besonderes Augenmerk soll auf folgende Aspekte gelegt werden:

  • Wie werden solche Kameras genehmigt, sind Studierende an dieser Entscheidung beteiligt, und wenn nein: warum?
  • Wer überwacht diese Kamerars?
  • Was geschieht mit den Daten; werden sie gespeichert?
Begründung: 

Eine Überwachungskamera ist anonym. Und sie hat kein Rotlicht, das anzeigt, ob jemand zuschaut oder nicht. Sie auch keinen Namen, ist kein Gegenüber. Die Beobachteten wissen nicht, ob zugeschaut wird, wer zuschaut, ob aufgezeichnet wird, wer sich die Aufzeichnungen anschaut.

Permanente Überwachung bedeutet permanente Verhaltenskontrolle. Zu den Auswirkungen einer jederzeit möglichen Aufzeichnung individuellen Verhaltens hat sich schon 1984 des Bundesverfassungsgericht geäußert: "Wer unsicher ist, ob abweichende Verhaltensweisen jederzeit notiert und Informationen dauerhaft gespeichert, verwendet und weitergegeben werden, wird versuchen, nicht durch solche Verhaltensweisen aufzufallen. Wer damit rechnet, dass etwas die Teilnahme an einer Versammlung der Bürgerinitiative behördlich registriert wird und dass ihm dadurch Risiken entstehen können, wird möglicherweise auf eine Ausübung seiner Grundrechte (Art. 8,9 GG) verzichten. Dies würde nicht nur die individuellen Entfaltungschancen des Einzelnen beeinträchtigen, sondern auch das Gemeinwohl." (BVfFG, NJW 1984, 422) Im öffentlichen Rum stellt die Überwachung einen Eingriff in das Recht auf informationelle Selbstbestimmung dar. Man darf nicht auf Kosten der Studierenden dem Fetisch moderner Technik verfallen.
